National safety laws are almost uniform now | The Small Business ...

Only Western Australia and Victoria have not yet passed legislation to bring their workplace safety into line with the national occupational health and safety legislation.? South Australia passed its laws this week.

A national survey by lawyers Herbert Smith Freehills suggested a third of board directors were unprepared for their obligations under the new laws, which carry individual penalties of up to $600,000 or five years prison.?? This is worrying and needs to be addressed.

A spokesman for WA Commerce Minister Simon O?Brien said that it would not be joining the national system until the Federal Government provided more information about accompanying regulations affecting the mining industry.

In fact many if not most mining companies have operations spanning several states and comply with the new legislation all ready.? The mining companies are very conscious of and proactive about workplace safety on their sites and also for their contractors and suppliers.? They are extremely proactive about identifying and managing risk.

The Australian Institute of Company Directors has complained the laws add to a growing burden on company directors which is all well and fine but while the laws exist, directors need to be aware of them and comply because quite apart from the moral obligation to have a safe workplace, it is simply too expensive if you are caught when something happens.

The new legislation makes you guilty until proven innocent so you need to have a good safety system in place and this is something I can help you with.?
